Measures for the Administration of Work-study for International Students in Institutions of Higher Learning

  Article 1 In order to regulate the work-study activities of international students in colleges and universities and improve the level of education opening to the outside world, in accordance with the “Exit and Entry Administration Law of the People’s Republic of China”, “The Regulations of the People’s Republic of China on the Administration of Entry and Exit of Foreigners”, and “Regulations on the Administration of Students in Ordinary Institutions of Higher Education” These measures are formulated according to the “Administrative Measures for the Admission and Cultivation of International Students in Schools”.

Article 2 These Measures shall apply to institutions of higher learning (hereinafter referred to as schools) that implement higher education for academic qualifications.

Article 3 The term “work-study assistance” as mentioned in these Measures refers to the practical activities of international students who, under the organization and management of the school, use their spare time to obtain legal remuneration through labor and use it to improve their learning and living conditions, excluding the school’s practice in accordance with teaching The program organizes international students to participate in teaching internships and social practice.

Article 4 The work-study activities on and off campus for international students are carried out under the unified leadership and overall arrangement of the school in accordance with the principles of having spare capacity for study, voluntary application, priority for helping the poor, and abiding by the law. The school shall formulate relevant implementation rules, clarifying the specific measures of work-study assistance for international students in the school and the powers and responsibilities of the corresponding internal functional departments.

Article 5 In principle, international students work on and off campus for no more than 8 hours per week and no more than 40 hours per month. During winter and summer vacations, in principle, no more than 16 hours per week and no more than 80 hours per month.

Article 6 The school shall not arrange or authorize students to participate in toxic, harmful and dangerous production operations, and must ensure that international students engaged in work-study activities have purchased insurance covering work-study activities.

Article 7 For international students to work-study on campus, the post should be mainly on-campus teaching assistants, scientific research assistants, administrative management assistants, and school public services. Positions are set up to meet the needs of students and avoid taking up normal study time. The remuneration of international students’ on-campus work-study activities shall be arranged by the school as a whole.

Article 8 Work-study international students are paid according to the following standards: fixed positions on campus are paid on a monthly basis. In principle, the remuneration of 40 working hours per month shall not be lower than the minimum living standard of local residents, and it can fluctuate appropriately.

On-campus temporary positions are paid hourly. The hourly remuneration can be reasonably determined with reference to the minimum hourly wage standard stipulated by the people’s government where the school is located.

The remuneration standard for off-campus work-study shall not be lower than the minimum wage standard stipulated by the local people’s government or relevant departments, which shall be determined by the employer through consultation with the student, and the amount of remuneration shall be stated in the employment agreement.

Article 9 To engage in off-campus work-study activities, international students must meet the following basic conditions:

(1) Be at least 18 years old and meet the physical conditions required for work-study positions;

(2) Hold a valid residence permit for study within the territory of China, and the remaining valid residence time is more than six months;

(3) Comply with Chinese laws and regulations and school rules and regulations, be of good character, perform well, and have no criminal record or violation of laws and regulations;

(4) Undergraduate students, graduate students, advanced students and research scholars who have been studying in the current school for more than one year;

(5) Academic progress and attendance rate meet the requirements of the school;

(6) Other conditions stipulated by the school.

Article 10 Students should submit a copy of the signed agreement with the employer to the school for recordation, and submit a unilateral commitment letter to make commitments on risk-taking and other aspects.

Article 11 International students who engage in work-study activities outside the school must submit the agreement, school certification letter and related materials to apply to the exit and entry administration department of the public security organ where the school is located within ten days in accordance with relevant regulations. Work-study related information such as deadlines. Off-campus work-study activities are not allowed with a residence permit without work-study information.

International students who change the off-campus work-study unit and period should submit a new agreement and the school’s certification letter to the local public security bureau’s exit and entry administration department to apply for a change of annotation information within 10 days.

International students who terminate off-campus work-study activities due to reasons such as the employer’s termination of the agreement should submit a written report to the school within ten days, and apply for information changes to the exit and entry administration department of the local public security organ.

Article 12 The geographical scope of work-study assistance is limited to the districted municipal administrative area where the school is located. The duration of each application for work-study shall not exceed the validity period of the study residence permit, and the maximum period shall not exceed one year.

Article 13 If an  international student is under any of the following circumstances, the school shall cancel his work-study qualification and report to the exit and entry administration department of the public security organ in a timely manner:

(1) Completed studies, dropped out of school, suspended or dropped out of school;

(2) Violating national laws and regulations or relevant school management systems;

(3) The moral character is inferior, violates social order and good customs, and causes adverse effects;

(4) Other circumstances where work-study is affected by work-study and other circumstances that the school determines that it is no longer appropriate to continue work-study.

Article 14 If an international student’s work-study program exceeds the scope of the post or the prescribed time limit, the exit and entry administration department of the public security organ shall investigate and deal with it according to law.

Article 15 Each provincial education administrative department shall, in conjunction with the local public security, immigration management, human resources and social security and other departments, coordinate and supervise the work-study activities of international students within their respective administrative regions, and guide schools within their respective administrative regions to combine their own schools and their According to the actual local situation, formulate and improve the implementation rules of work-study for international students, and implement dynamic management of the scope of work-study positions for international students in accordance with relevant local regulations.

Article 16 The school shall earnestly fulfill the main responsibility of the work-study management of international students, strengthen the daily education, inspection and tracking management, and regulate the on-campus and off-campus work-study activities of international students.

Article 17 These Measures shall come into force from the date of issuance.
